Unsafe Stairs & Stairway Accidents

Dangerous PropertiesWith the privilege of property ownership in California comes a responsibility – to keep areas that are used by visitors safe for those visitors. This includes the obligation to fix problem areas and to conform to building codes.

Unfortunately, many property owners do not take their ownership responsibilities seriously, allowing their property to fall into a state of disrepair. This can be especially dangerous when stairways and stairwells are involved. If a property owner fails to maintain stairways and stairwells, serious injuries can result, mostly involving falls. Falls are the second leading cause of unintentional injury death for all people in the U.S. and the leading cause for people over the age of 60. Children under the age of 14 are also at high risk for falls and account for 27 percent of non-fatal falls.

Some of the dangerous conditions around stairs that could lead to dangerous falls include a poor design of the stairs, poor construction or maintenance of the stairs, lack of or broken handrails or railings, bad lighting, and slick surfaces. Many times, upon inspection following an injury, we find serious building code violations. Falls due to some of these dangerous conditions could cause a variety of physical problems, such as brain injuries, broken bones, and soft tissue damage. Some individuals, especially those who are older, may never recover from those injuries.

Have you or a loved one been injured due to unsafe stairways or stairwells in southern California? If so, contact premises liability attorney Donald Sjaarda at 714-963-8216. You may have a cause of action against the property owner or others for your injuries. Some injured plaintiffs can recover for their past and future medical expenses, lost wages, pain and suffering and more.
